Court Rules Man Not Criminally Responsible in Attack on Jewish Father, Dismisses Hate Crime Motivation

The man accused of attacking a Jewish father in front of his children at a park in Parc-Extension has been deemed not criminally responsible after a psychiatric evaluation. The 23-year-old, Sergio Yanes Preciado, was found to have been in a state of psychosis during the incident, unable to understand the wrongfulness of his actions. The attack, which involved spraying the father with water and physically assaulting him, was captured on video but did not show what led to the altercation.

Despite initial concerns of a hate-motivated crime, the psychiatric evaluation revealed that Yanes Preciado harbored no animosity towards the Jewish community and would have reacted similarly if he felt persecuted by someone of a different faith. He was charged with assault causing bodily harm, but the ruling of non-criminal responsibility means he will be detained in a hospital for further evaluation by the Mental Disorders Examination Commission.
