Court Denies FMSQ Appeal Rights Under Bill 2, Sparks Legal Controversy

The Quebec Federation of Medical Specialists (FMSQ) faced a setback in their attempt to appeal two court decisions as Judge Myriam Lachance of the Court of Appeal denied their request for permission to appeal. The first decision by Superior Court Justice Pierre Nollet rejected the FMSQ’s bid to submit anonymized affidavits from physicians challenging the validity of Bill 2. The FMSQ argued that these affidavits were redacted to protect the physicians from potential repercussions, but the court disagreed.

In a separate ruling, Judge Nollet declined to provide an interpretation of the law regarding sanctions for certain actions by physicians, as requested by both parties involved. The Attorney General of Quebec had presented an interpretation limiting sanctions for actions like retirement or relocation. Judge Lachance upheld the discretion of the trial judge in deciding whether to hear such cases and found no evidence of unreasonable exercise of judicial discretion in this instance.
