A lawsuit has been filed against Communauto, a popular car-sharing service. The lawsuit claims that the company violated the Consumer Protection Act by placing an expiry date on their Flex 20 passes, restricting users from using all their allocated trips.
Specifically, the lawsuit focuses on the Flex 20 passes, which allow users to take 20 trips lasting 30 minutes each. According to the claim filed in December with the Superior Court, a user alleges that her passes expired one month after purchase, which she believes is a clear violation of the Consumer Protection Act.
Represented by the law firm Faguy & Cie, the claimant is targeting individuals who bought Flex 20 passes but were unable to utilize all their trips between Nov. 16, 2022, and March 3, 2025.
In response to the lawsuit, Communauto made changes to their pass terms on March 3, as communicated through an email in February. The company removed the expiry date on passes but reduced the number of trips offered from 20 to 15.
Although Communauto’s website still stated that unused trips would not carry over to the next month, the plaintiff criticizes the conflicting information provided to subscribers.
Despite attempts to reach out for comments, Communauto did not respond to inquiries earlier on Tuesday.
It is important to note that the court will need to authorize a class action before delving into the merits of the plaintiff’s arguments.
