The judge dismissed the federal murder charge that allowed prosecutors to seek capital punishment, citing technical flaws. Instead, the case will proceed with stalking charges that carry a maximum penalty of life in prison. Prosecutors can use evidence collected from Mangione’s backpack, including a handgun and a notebook detailing his plans. The rulings may be subject to appeal, giving prosecutors 30 days to decide. The trial is set to begin with jury selection on Sept. 8.
