Three Men from Scotland to Face Trial in Canada for Restaurant Owner’s Death
Three men, all part of the same family, have agreed to be extradited from Scotland to Canada to stand trial for their alleged involvement in the death of 44-year-old restaurant owner Sharif Rahman in Owen Sound, Ontario. The incident occurred when Rahman was assaulted outside his restaurant in August 2023 and later succumbed to his injuries.
Robert Evans, 24, is facing a charge of manslaughter in connection with Rahman’s death, while his father, Robert Busby Evans, 47, and uncle Barry Evans, 54, are charged with being accessories after the fact to commit an indictable offense.
In a hearing before Sheriff Julius Komorowski at Edinburgh Sheriff Court, all three men consented to extradition, with Robert Busby Evans acknowledging that the matters should be addressed by the Canadian justice system.
The allegations involve Robert Evans Jr. allegedly striking Rahman during a dispute over an unpaid bill, leading to Rahman’s tragic passing. Barry Evans is accused of aiding his nephew in evading arrest, while Robert Busby Evans is accused of facilitating his son’s return to the U.K. after the incident.
The sheriff confirmed that the alleged conduct of Robert Busby Evans and Barry Evans met the dual criminality requirement under Scottish law for extradition, while there was no question of dual criminality for Robert Evans’ charge of manslaughter.
The men have been remanded in custody while their cases are referred to Scottish ministers, with the extradition process set to proceed.
