The English Montreal School Board (EMSB) has reached a significant agreement with individuals who came forward alleging they were victims of sexual assault by former principal Phillip Baugniet.
According to the terms of the settlement, the EMSB and the Baugniet estate may pay out a sum ranging from $3.4 million to $8.725 million, based on the number of valid claims submitted as part of a collective legal action.
Phillip Baugniet served in various roles within the school board from 1966 to 1991, including as a principal, teacher, manager, and supervisor.
The reported incidents of assault took place involving students from Lachine High School, Victoria School, and FACE School.
Tragically, Baugniet passed away in April 2025 while the trial was ongoing, having commenced at the start of that year.
The class-action lawsuit was initiated four years ago, with the primary plaintiff referred to only as “C” for confidentiality reasons.
Should over 46 claims be determined as valid, the lead plaintiff may choose to manage the Global Settlement Fund for equitable distribution among all eligible members of the class, or opt to renegotiate the terms in good faith, subject to court approval.
A retired judge will act as an impartial adjudicator to assess the validity of claims and assign appropriate compensation categories. The claims process will be overseen independently, with no involvement from the EMSB or the Baugniet estate.
The proposed settlement still requires the green light from the Superior Court of Quebec, with a hearing scheduled for Oct. 28 at the Montreal courthouse to review the settlement terms, claims procedure, and legal fees for the class counsel.
Upon approval, the legal team representing the class will furnish additional guidance on how victims can submit their claims, outlining the application process and deadlines.
