In the peaceful community of Unionville in Markham, Crosby Park is typically a battleground for sports enthusiasts competing on its baseball fields or ice arenas. However, a different kind of conflict arose in September when multiple individuals discovered their vehicles had been unintentionally sprayed with paint.
Teruyuki Koidezawa noticed the paint splatters on his car after attending skating lessons with his children at the Markham Village Arena. Similarly, Sandra Osbaldeston found her vehicle covered in white paint after parking near the Unionville Curling Club arena, where roofing work was taking place.
Despite efforts to remove the paint, both Koidezawa and Osbaldeston ended up needing their vehicles repainted, incurring significant costs. They, along with other affected vehicle owners, sought compensation from the roofing company responsible for the overspray.
The roofing company, represented by Patrick Austin, claimed that the contract signed with the curling club explicitly stated they were not liable for overspray damage to vehicles or property. However, disputes arose over the adequacy of warnings and precautions taken during the roofing work.
While the Unionville Curling Club emphasized the roofing company’s responsibility, Austin argued that the club failed to adequately inform neighbors of the potential risks. As the disagreement continues, affected individuals like Koidezawa and Osbaldeston are considering legal action if a resolution is not reached.
